Terms and Conditions

1. General terms and conditions:

By filling in the order form on site and confirming the order, the user's full and entire acceptance of these general terms and conditions of sale is valid.

MGK Technologies reserves the right to refuse an order in the event of the customer's negligence of one or the other of its obligations and, in general, the refusal of an order that is of an abnormal nature for any reason.

2. The customer's obligations:

The customer undertakes to fill in the order form accurately.

In the event of erroneous entries by the customer, and especially errors in entering the e-mail address of delivery, MGK Technologies will not be able to be held responsible for an erroneous delivery.

3. The price:

The prices indicated at the point of sale are guaranteed subject to changes in the VAT rate.

These prices are net and inclusive of VAT. The VAT applied depends on the buyer's country. For Luxembourg, prices are inclusive of 17% VAT. For Belgium, prices are inclusive of 21% VAT.

Billing without VAT will be done only for business customers with an intra-community VAT number which has been validated by the European Commission's VAT number validation service. NOTE. Fraudulent use of an intra-community VAT number (carousel fraud) may lead to legal prosecution of the fraudsters.

4. The payment:

Payments of purchases are made only with the indicated payment cards in the online shop.

The validation or not of the payment is immediate. Only validated payments will generate the sending of an e-mail containing the validation codes of the product(s).

5. The delivery:

The delivery of the ordered product(s) will be made only by e-mail.

The general established shipping time is equal to approximately one (1) hour after payment, except in case of network congestion problems, network saturation, etc...

In all cases, the delivery will be made at most on the next working day after the on-line payment.

6. Automatic renewal

As a customer of ESET's products you have the possibility to subscribe to the automatic renewal service for private individuals free of charge.

1. 6.1 Automatic renewal and licensing

   In case of automatic renewal, the renewed licences will be on an equal basis. This means that we will renew your licence at the time of renewal with the following criteria:

   • The same ESET product as owned
   • The same number of seats
   • The same number of licence years

   The price of the automatic renewal will be communicated to you 30 days before the expiry of your licence.

2. 6.2 Conditions for subscribing to the automatic renewal service

   Automatic renewal is available to any customer who has purchased an ESET licence in the ESET Belgium and Luxembourg eStore.

   Membership can be done in 2 different ways:

   • During the purchase on the Site from the shopping cart
   • After the fact by logging into your customer area linked to your licence

   Any membership request that does not meet these criteria will not be considered.

3. 6.3 Email notifications

   30 days before the expiry date of your auto-renewal licence, we will send you a reminder email.

   This email will also contain the following:

   • the renewal price that will be applied
   • the duration for which the renewal will take place
   • a link to manage your preferences

4. 6.4 Cancelling the automatic renewal of your licence

   You can cancel the automatic annual renewal of the software at any time by logging in to your customer area on the Belgian and Luxembourg eStore.

6. 6.5 Updating your data

   For automatic annual renewal, payment is made using the payment details we currently have of you and the Product. We accept no liability for any loss you suffer as a result of our inability to complete the annual automatic renewal, to deliver the Product in the event that your payment details are no longer valid.

7. Complaints :

The customer must ensure that the delivery conforms to the order. Concerning the renewal licenses, the update is done automatically (i.e. once the purchase is made and validated on our shop, and without any intervention on your part, it is not necessary to register it), so any complaint will have, to be taken into account, to intervene in the 48 hours following the reception of the email(s) of validation of the order. Complaints can only be made by e-mail to the following address: e-commerce@mgk.lu

8. The use of the information technology data collected :

The computer data collected in connection with the Internet sales are intended only for MGK Technologies' own use. They allow it to process orders, as well as to inform our customers about our products and promotions.

9. Security of transactions :

Payment by credit cards is insured by the company Six Payment located in Luxembourg. The transaction between the customer and Six Payment is highly secured. The banking information supplied by the customer is encrypted and will never circulate in clearness on the Internet network. MGK Technologies is not aware of any credit card number.

10. Courts :

This contract is governed by the laws of the Grand Duchy of Luxembourg. In case of dispute, only the courts of Luxembourg have jurisdiction.

11. Mediator

In the event of a dispute, the consumer has the possibility of having recourse to a consumer mediator by calling upon the following body:
